Welcome to Anyvids ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our website and AI tools, including text-to-image, image-to-image, text-to-video, image-to-video, and other AI-based creative utilities (collectively, the "Services").

By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use Anyvids.

1. Eligibility

Our Services are not intended for individuals under 16 years of age. By using Anyvids, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to maintain the security of your credentials.

You are responsible for all activity under your account. Notify us immediately at support@anyvids.ai if you suspect unauthorized access.

3. Subscription and Payments

• Anyvids offers both free and paid subscription plans.
• Subscription fees and available plans are displayed within the Service.
• Payments are processed through trusted third-party platforms (e.g., Stripe, Creem).
• Subscriptions renew automatically unless canceled before the renewal date.
• Refunds, if any, are handled according to applicable consumer laws or the policies of the payment platform used.

4. Refund Policy

4.1 Refund Eligibility

Time Limit & Credit Type: Refund requests are only applicable to subscription credits and must be made within 3 days of your purchase. For add-on credits, we cannot process any refund requests.

Credit Usage: If you have used more than 100 subscription credits, you are not eligible for a refund, regardless of the time since purchase.

4.2 How to Request a Refund

If you meet the eligibility criteria and wish to request a refund for subscription credits, please follow these steps:

1. Contact Us: Reach out to our support team at support@anyvids.ai.
2. Provide Details: Include your account details, order number, purchase date, and reason for the refund request.
3. Submit Within 3 Days: Ensure your request is submitted within 3 days of your purchase.

Tip: Add-on credits are non-refundable.

4.3 Processing Refunds

We will refund only the unused portion of your subscription; used portions are non-refundable.

Once we receive your refund request, we will review it within 5 business days. If approved, your refund will be processed to your original payment method.

Please note that the refund amount may be subject to a processing fee not exceeding six percent (6%) of the initial payment, and that add-on credits are not refundable.

5. User Content

You may upload or provide text, images, videos, or other materials ("User Content") to use the Services.

• Ownership: You retain all ownership rights to your User Content.
• License to Anyvids: By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display the content solely for the purpose of providing and improving our Services.
• Responsibility: You represent that your content does not infringe on any third-party rights and complies with all applicable laws.

6. Generated Content

Our AI systems generate outputs ("Generated Content") based on your inputs.

Usage Rights:

• Free users may use Generated Content for personal, non-commercial purposes only.
• Paid (subscribed) users are granted a commercial license to use their Generated Content.

You are solely responsible for how you use Generated Content, including compliance with intellectual property and content laws in your jurisdiction.

Anyvids does not guarantee that Generated Content will be unique, free from similarity to existing works, or free from third-party rights claims.

7. Prohibited Uses

You agree not to use Anyvids for any of the following:

• Illegal, harmful, or misleading activities.
• Generating or distributing sexually explicit, hateful, or violent content.
• Attempting to reverse-engineer, scrape, or misuse our Services.
• Uploading content that violates intellectual property or privacy rights.

Anyvids reserves the right to suspend or terminate accounts violating these Terms.

8. Intellectual Property

All intellectual property rights in the Anyvids platform, including software, website design, and underlying AI models, belong to Anyvids or its licensors.

Nothing in these Terms transfers ownership of such rights to you.

9. Termination

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or engage in misuse of the Service.

Upon termination, your license to use the Service and Generated Content (if non-commercial) will end, but ownership of your User Content remains with you.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis.

Anyvids makes no warranties about the accuracy, reliability, or availability of the Services.

Use of the Services is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Anyvids and its affiliates shall not be liable for:

• Any indirect, incidental, or consequential damages;
• Loss of profits, data, or goodwill;
• Any claim exceeding the amount you paid to us in the previous three months (if applicable).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Anyvids is located, without regard to its conflict of laws rules. The courts in some countries will not apply these jurisdiction's laws to some types of disputes. If you reside in one of those countries, then where these jurisdiction's laws are required to apply, the laws of your resident country will apply to such disputes related to these Terms.

13. Changes to These Terms

We may modify these Terms periodically. The latest version will always be posted on our website with the "Last Updated" date. Continued use of the Services after changes means you accept the revised Terms.
